General information

1.1 The terms and conditions of sale determine the offer, sale and delivery of all products made by or on behalf of Nutrined and apply to all similar transactions between Nutrined and the customer. The client recognizes to be familiar with and accepts the full version of the terms and conditions of sale. The customer should always read the terms and conditions for internet sales before an internet order. With every order, the customer will be asked to confirm that he expressly accept these conditions.

1.2 these sales conditions are effective immediately. They are subject to change at any time which will have immediate effect and without prior notification will be effective.

1.3 the meaning of the term "products" in the terms and conditions of sale: the finished product is ready for sale for which reduced description is displayed.

ART 1 – PRICE

The prices on our site are in Euros and include all taxes, delivery costs excluded. Any delivery costs to the user specified in function of its product selection and are invoiced to him at the end of the order, in addition to the price of the selected products.

The indicated prices can changes. When an order is entered, the price for the order will be the price indicated on the website at that moment. If the price stated on our site would be increased or decreased between order and delivery, or if we would have made an error while entering the prices at our site, the customer will be notified and we have agreed to ask the product to be delivered at the right price.

ART 2 – AVAILABILITY

We carry out the orders according to available stocks.If one of the ordered products are not in our stock, we will notify you by e-mail within 5 days from the date of your order, to notify you of this and to specify the period within which the product would be delivered.

The products will be sent after receiving of the payment. Delays can in no case lead to the cancellation of the order nor any compensation.

ART 3 – RIGHT OF WITHDRAWAL, SATISFIED OR REIMBURSED

The customer enjoys 7 calendar days (provided for in Article L 121-20 of the Consumer Protection Law) to give us a product that does not satisfy and return it. The product is at the expense of the customer returned together with the purchase receipt. Only products that are new, complete and in the original unopened packaging (goods packed in blister or sealed boxes can only be returned if the customer has not been unsealed) may be returned. A damaged product is not refundable. If the item is returned incomplete or damaged, no refund will be done and the product remains at the disposal of the customer in our warehouse. It will not be send for a second time. The above time limits begin to run from the day following receipt of the order. The repayment is done through bank transfer to the account of the customer which he will specify. The right of withdrawal does not apply to professionals.

ART 4 – WARRANTY

Any returns must be done through the Post or any other carrier. The customer will ensure that the goods are safeguarded for all damage could be caused during transport. If the goods are damaged or lost during return transport, the buyer can only appeal to the carrier that he has hired. The shipping costs will be borne by the customer. Please note that the warranty does not apply to compensation for damages due to external causes (accidents, shock, lightning,...) or a fault of the customer arising from use not in accordance with the suggested use. Therefore, the customer is asked to read the information supplied on the label of the product, in detail.

ART 5 – PROTECTION OF PRIVACY AND PERSONAL INFORMATIONS

The data will be processed in accordance with the provisions of the Act of 8 December 1992 concerning the processing of personal data. This means that: Personal data may only be collected and processed to respond to requests for information you have provided. Personal data will not be communicated to third parties and are not used for commercial purposes. You have the right to consult your personal data and the accuracy of that act. Please report any errors to be corrected. To do this, please contact the administrator of the site. We commit ourselves to the most extensive security measures to prevent third parties abuse these personal data which you have communicated.

ART 6 - APPLICATION

Our sales are subject to the Dutch law and only present general conditions are applicable, except by special agreement. All other conditions we would be submitted are invalid. The placing of an order implies the acceptance by the buyer of both our general conditions and our special sale conditions.

ART 7 – TRANSPORT

Transport costs are borne by the buyer. Regardless of the method of shipment and the place of delivery, the goods always travel at the risk of the consignee as soon as they leave our warehouse, except story of the buyer against the carrier. In cases of alleged damage or loss of the goods, the consignee shall report damage upon receipt to the driver.

ART 8 – COMPLAINTS

To be considered, comments or complaints must be sent to us regarding our delivery within eight days after receipt thereof.

ART 9 - COURTS

Only the courts of Goirle have jurisdiction to rule on any disputes which may arise between the parties.

ART10 - EXPORT

Upon delivery, Nutrined shall not be liable for damages resulting from any destruction, loss, seizure, destruction or damage of the products due to import control, lack of approvals, product inspections, customs duties or other circumstances related to the export and shipment of the products.
